1. Services and Hazardous Materials
Subject to the terms and conditions set forth in the Master Agreement, as requested in one or more Work Orders or Change Orders, HazarGo provides transportation services related to hazardous substances generated by the customer. The customer must provide advance written notice of any proposed shipment of hazardous substances. Before transportation, the customer must supply a current material safety data sheet or any other required documentation. The customer acknowledges that HazarGo does not independently analyze or verify the hazardous substances but relies on the information provided by the customer, which must be true, accurate, and complete. The customer also warrants that any hazardous substance containers retrieved will comply with all applicable laws and regulations. HazarGo reserves the right, but not the obligation, to inspect, analyze, and test any hazardous substances before transportation. Failure to do so does not relieve the customer of its responsibilities.
2. Nonconforming Substances
If the customer delivers or HazarGo retrieves any nonconforming substances, HazarGo will notify the customer immediately. HazarGo may then: (a) require the customer to collect and remove the nonconforming substances, (b) return the nonconforming substances to the customer, (c) transport and dispose of the substances at a lawful facility, or (d) agree to an alternative lawful disposal method. The customer is responsible for all expenses incurred by HazarGo in handling such substances. Nonconforming substances include hazardous substances for which the customer fails to notify HazarGo, provide required documentation, or that do not match the descriptions provided by the customer.
3. Transportation Services
HazarGo will transport and deliver hazardous substances to designated disposal facilities in compliance with applicable laws, regulations, and agreements. The customer is responsible for verifying the accuracy of all hazardous substance descriptions, quantities, and compliance with packaging, labeling, and shipping requirements before transport.
4. Risk of Loss
Risk of loss passes from the customer to HazarGo upon acceptance of the hazardous substances for transportation but remains with the customer after delivery to the designated disposal facility. If any event resulting in injury, property damage, or environmental contamination occurs during transportation, HazarGo will notify the customer immediately. Title to hazardous substances remains with the customer at all times. HazarGo does not bear risk of loss for nonconforming substances.
5. Retrieval and Disposal Sites
The customer is responsible for selecting and communicating retrieval and disposal facility locations to HazarGo. The customer warrants that the designated facility is properly permitted to receive hazardous substances. If a facility rejects delivery, HazarGo will notify the customer and follow their instructions. Additional costs due to facility rejection will be the customer’s responsibility if caused by incorrect descriptions, improper labeling, or regulatory violations.
6. Charges
In addition to rates specified in Work Orders or Change Orders, the customer may incur additional charges, including fuel surcharges, costs for additional equipment, personnel, or regulatory fees imposed by authorities.
7. Indemnification
The customer agrees to indemnify, defend, and hold harmless HazarGo and its affiliates, employees, and agents against all claims, losses, damages, penalties, and expenses, including legal fees, arising from: (a) disposal facility liabilities, (b) hazardous substances not in HazarGo’s custody, and (c) nonconforming substances, whether in HazarGo’s custody or not.
8. Amendments and Updates
HazarGo reserves the right to update or amend these terms and conditions at any time. Customers are encouraged to review this page periodically for any changes.
